Please read these Terms & Conditions carefully before using Locafy Egypt. By accessing this website, creating an account, or placing an order, you agree to be bound by these terms and related policies.

Introduction

Introduction

This document regulates the relationship between the Locafy platform and each user or consumer interacting with it. It aims to ensure a safe and transparent digital environment for sales and purchases and to protect the rights of all parties in accordance with applicable Egyptian laws.

By using the platform, creating an account, making any purchase, or interacting with it in any way, the user agrees to comply with all terms and conditions in this document, including any related policies such as the Privacy Policy, Shipping and Delivery Policy, Return and Exchange Policy, and any future updates announced on the platform.

These terms set out the rights and obligations of users and the platform, the mechanisms for using the services, payment and shipping methods, return and exchange procedures, and limits of liability.

Section One

Definitions

Unless the context otherwise requires, the following terms used in these Terms and Conditions shall have the meanings set out below.

Platform: The Locafy electronic platform in its version dedicated to the Arab Republic of Egypt, including the website, applications, technical systems, associated digital services, interfaces, database, designs, and all published digital content.

Document: These Terms and Conditions in full, together with any later amendments or updates published by the Platform.

Supplementary Terms and Policies: Any related legal or operational policies issued by the Platform, including the Privacy Policy, Shipping Policy, and Exchange and Return Policy, which form an integral part of this document.

Owner: The company LOCAFY which owns and operates the Platform and is legally responsible for its management, including its employees, agents, experts, legal representatives, and affiliated companies to the extent permitted by law.

User: Any natural or legal person who creates an account, browses the Platform, or orders products or services through it, including unregistered visitors who interact with the Platform.

Consumer: Any natural user who purchases or orders products or services through the Platform for personal, home, or family use and not for resale or commercial use.

Supplier / Merchant: Any natural or legal person offering or selling products or services through the Platform and fully responsible for product quality, safety, and compliance with applicable specifications.

Products: All goods or services offered through the Platform, whether new or used, physical or digital, available for purchase or order.

Services: Non-material activities offered by the Platform or its suppliers, including after-sales services, technical support, special packaging, delivery, or future approved services.

Order: The process by which a Consumer selects products through the Platform and confirms the desire to purchase them.

Payment: Payment for products or services through methods available on the Platform, including cash on delivery, bank cards, or other approved payment tools.

Refund: The repayment of amounts paid by the Consumer in accordance with the applicable Exchange and Return Policy.

Shipping and Delivery Policy: The procedures and mechanisms adopted by the Platform for transporting and delivering products, including dates, costs, and responsibilities.

Personal Account: A User’s personal electronic space on the Platform that allows order management, purchase tracking, and access to Platform services.

Content: All texts, images, graphics, recordings, data, logos, designs, and materials available through the Platform.

Promotional Offers and Discounts: Marketing campaigns, price reductions, coupons, loyalty programs, or gifts offered by the Platform, suppliers, or both.

Privacy Policy: The rules regulating the collection, use, storage, protection, and processing of Users’ personal data in accordance with Egyptian law.

Force Majeure: Any exceptional event beyond the control of the Platform, Supplier, or Consumer, including natural disasters, fires, floods, wars, riots, epidemics, technical failures, or government decisions.

Applicable Laws: All laws, regulations, and executive decisions in force in the Arab Republic of Egypt, including any amendments.

Disputes: Any dispute, claim, or legal action arising between the User and the Platform or Supplier in relation to these Terms and Conditions or transactions made through the Platform.

Notifications: Any correspondence, messages, or alerts sent by the Platform through email, SMS, account notifications, or other approved means.

Amendments: Any changes or updates made by the Platform to these Terms and Conditions or related policies, effective upon publication unless otherwise stated.

Section Two

Terms of Use

First: Scope of Application and Legal Capacity

1. Applicability of Terms

The User’s access to the Platform, use of any of its services, or interaction with any of its pages, applications, or systems is subject to the terms and conditions contained in this document. Browsing the site, creating an account, completing a purchase, exchange, return, complaint, or review constitutes explicit consent to comply fully with these terms.

2. Legal Capacity of Users

The User must have full legal capacity to contract in accordance with applicable Egyptian law. The Platform may refuse registration for anyone lacking such capacity. Any unauthorized use by legally incapable persons is at their own risk, and the Platform may claim compensation for direct or indirect damages.

3. Legal Nature of the Relationship

The Platform acts as an electronic intermediary providing a secure technical environment that allows Consumers to access products and services offered by Merchants or Suppliers. Responsibility for product quality, conformity, health safety, and legal compliance remains with the Supplier.

Second: Acceptance and Amendment of Terms

1. Contractual Acceptance

By using the Platform through the website, application, or any related digital means, the User gives final and irrevocable acceptance of all terms and conditions.

2. Platform’s Right to Amend

The Platform may amend or update the Terms of Use from time to time in line with legislative, technical, operational, or security developments. Continued use of the Platform after publication of an amendment constitutes acceptance of the amended terms.

Third: Account Creation and Data Registration

1. Account Creation

To benefit from Platform services, the User must create a personal account using correct, complete, and accurate information, including legal name, address, email address, and phone number. The User must update this information whenever it changes and must not use false data, impersonate others, or use fake accounts.

2. Responsibility for Account Confidentiality

The User is fully responsible for maintaining the confidentiality of account login details and for any activity conducted through the account. The Platform is not liable for unauthorized use resulting from the User’s failure to protect account information.

3. Suspension or Termination of Accounts

The Platform may suspend, block, or cancel a User account where misleading information, illegal activity, or a violation of this document is detected. The User may request account closure at any time, subject to any prior legal or financial obligations.

Fourth: General Obligations of the User

The User must use the Platform in compliance with Egyptian laws and any relevant international laws. The User must not engage in unlawful conduct, misuse the Platform name, trademark, or logo, or associate the Platform with illegal or offensive content. The Platform may suspend or cancel an account for any such violation.

Fifth: Lawful Use of Services

The User may use the Platform only for legitimate and authorized purposes, mainly purchasing offered products in accordance with this document.

The User must not resell products in the Platform’s name without written consent, and must not publish offensive, defamatory, or misleading comments or reviews.

If the User violates these rules, the Platform may:

  • remove comments or content without prior notice;
  • suspend or permanently cancel the account; and
  • take legal action and claim compensation for damages.

The Platform may also refuse or cancel any order or payment transaction where illegal activity, fraud, money laundering, or unjustified commercial quantity purchasing is suspected.

Section Three

Users' Rights Regarding the Platform

First: Provision of Services and Continuity of Operation

The Platform shall make reasonable technical, administrative, and legal efforts to ensure service continuity and address malfunctions as quickly as possible. The Platform may carry out maintenance and updates as necessary and shall not be liable for temporary interruptions caused by force majeure or events beyond its control.

Second: Protection of Personal Data and Confidentiality

The Platform is committed to protecting Users’ data in accordance with applicable laws and will use such data only for purposes related to providing, improving, or developing services. It shall take the necessary technical and administrative measures to secure personal data and will not sell or share it with third parties without consent unless required by law.

Third: Accurate and Clear Product Information

The Platform aims to display products and services with accurate and complete information, including price, description, components, origin, warranty, and return or exchange terms. If errors are discovered, the Platform will correct them promptly. Responsibility for the accuracy and safety of product information ultimately remains with the Merchant or Supplier.

Fourth: Transparency in Electronic Transactions

The Platform will notify Users of transaction details such as orders, payments, shipping, and cancellations through email, SMS, or account notifications. It also allows Users to track order status until delivery.

Fifth: Complaint Mechanisms and Technical Support

The Platform provides communication channels for complaints, inquiries, and feedback, including customer service, email, or electronic forms. Complaints shall be handled within a reasonable time and the User may receive updates until the matter is resolved.

Sixth: Scope of Compensation

Any compensation due to a User shall be limited to direct damages only and shall not include indirect losses, lost profits, or consequential damages.

Section Four

Intellectual Property Rights

First: Ownership of Content and Trademarks

All rights related to content published on the Platform, including text, images, graphics, logos, trademarks, designs, icons, videos, digital materials, and databases, belong to the Platform, its Suppliers, or affiliated third parties. The User may not claim ownership or exploit them without an express license.

The Platform’s trademarks, logos, and domain names are protected by Egyptian and international intellectual property laws. Their use is prohibited without prior written permission.

Second: Prohibition of Reproduction and Publication

The User may not copy, reproduce, distribute, republish, or use any Platform content for commercial, advertising, or promotional purposes without prior written authorization from the Platform or the legal rights holder.

Third: Protection Against Violations

The Platform reserves the right to take all legal action against violations of intellectual property rights, including filing civil or criminal claims, seeking compensation, and suspending or permanently blocking violating accounts.

Section Five

Payment and Purchase Policies

First: Available Payment Methods and Options

The Platform may provide payment methods including bank cards, approved digital wallets, and cash on delivery, depending on the product or service.

The Consumer must use only lawful payment methods that belong to them or are authorized for their use. The Platform may suspend or cancel any order where payment fails or fraud or suspicious activity is detected.

Second: Pricing and Taxes

All prices displayed on the Platform are shown in the local currency unless otherwise stated and may include or exclude taxes, shipping, or other charges depending on the product page. The Platform may amend prices at any time before order confirmation and may cancel orders affected by obvious pricing errors.

Third: Order Confirmation and Completion

An order is considered submitted once the Consumer completes checkout and receives order confirmation. The Platform may contact the Consumer to verify order details, payment information, or delivery address before final acceptance. The Platform may reject or cancel orders before shipment if products are unavailable, payment is unsuccessful, or legal or operational issues arise.

Section Six

Shipping, Delivery, and Order Fulfillment Policies

First: Shipping and Delivery

The Platform and/or Supplier shall make reasonable efforts to deliver products within the estimated periods announced on the Platform. Delivery times are estimates only and may vary due to operational conditions, force majeure, geographic restrictions, or courier delays.

The Consumer must provide a valid and complete delivery address and ensure availability to receive the shipment. Additional shipping charges may apply depending on the delivery area, product type, or selected method.

Second: Failed Delivery and Non-Receipt

If delivery cannot be completed because of incorrect address details, unavailability of the recipient, refusal to receive the shipment without valid reason, or repeated failed attempts, the Platform may cancel the order or charge additional delivery fees.

Third: Inspection Upon Delivery

The Consumer should inspect the shipment upon receipt and verify its visible condition, quantity, and apparent conformity. Any visible damage, defect, or discrepancy should be reported promptly according to the applicable complaint or return procedures.

Section Seven

Exchange, Return, and Refund Policy

First: General Principles

Exchange, return, and refund requests are subject to the Platform’s applicable policy and the laws in force in the Arab Republic of Egypt. Requests may only be made within the announced period and where the product satisfies the required conditions. Certain products may be excluded for health, hygiene, customization, or legal reasons.

Second: Conditions for Return or Exchange

The product must be returned in its original condition, unused except as reasonably necessary for inspection, and accompanied by accessories, labels, packaging, invoices, and promotional items where applicable.

The Platform may reject requests where the product has been damaged due to misuse, improper handling, or unauthorized alteration by the Consumer.

Third: Refund Mechanism

Approved refunds shall generally be processed through the same payment method used for the original transaction, unless otherwise permitted by law or policy. Refund timing may vary depending on the payment provider, bank, wallet operator, or operational review. Shipping or service fees may be non-refundable where the return is not caused by product defect or Platform error.

Section Eight

Dispute Settlement and Complaint Handling

First: Complaints and Internal Resolution

Users may submit complaints through the communication channels specified by the Platform. The Platform may request supporting documents or clarification from the User and the User must cooperate in good faith during review.

Second: Amicable Settlement

The parties should seek to resolve disputes amicably where possible before initiating judicial proceedings. Nothing in this document prevents a party from seeking urgent legal protection where required by law.

Third: Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Arab Republic of Egypt. Subject to any mandatory procedures or agreed settlement mechanisms, the competent Egyptian courts shall have jurisdiction over disputes arising from or related to the use of the Platform.

Section Nine

General Provisions and Limitations of Liability

First: Force Majeure

Neither the Platform, the Supplier, nor the Consumer shall be considered in breach where performance is prevented or materially delayed by force majeure, including natural disasters, fires, floods, wars, riots, epidemics, technical failures, or sudden government decisions.

Second: Limitation of Liability

Responsibility for product safety, quality, and conformity remains with the Supplier or Merchant providing the products and information. The Platform acts as an electronic intermediary and shall not be liable for product defects beyond the scope of this document.

The Platform shall not be liable for indirect or consequential damages including lost profits, lost data, business interruption, or other financial losses arising from use of the Platform or purchased products.

The Platform aims to provide accurate information but does not guarantee that all content is free from error or incompleteness and is not liable for losses caused by reliance on published information.

In all cases, the Platform’s maximum financial liability shall not exceed the amount paid by the Consumer for the product or service in dispute.

The Platform reserves the right to protect its rights through legal action, content restriction, account suspension, and claims for compensation where appropriate.

Third: Amendments and Transferability

The Platform may amend this document or any related policy at any time. Any amendment becomes effective upon publication, and continued use of the Platform constitutes acceptance of the revised terms.

No User or Consumer may transfer or delegate any right or obligation under this document without prior written consent from the Platform.

Fourth: Governing Law and Jurisdiction

This document shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, and Egyptian courts shall have exclusive jurisdiction over disputes, subject to any amicable settlement or arbitration provisions where applicable.
